Why is there even a Cuban base any longer?
The prisoners should be held in the vicinity of where they were captured. The statute of limitations should not last longer than the series run of Hogan's Heroes. When the war is over most of the prisoners are released, except for some top officers and state officials.
there are no officers or state officials in a global war against a stateless enemy. There are no real leaders to capture or surrender. Most of the guys at Guantanimo were small fries, conscripts, or just random guys turned in for the bounties.

This American Life did an indepth program on the terrorists at Guantanamo and their legal rights and treatment. It takes about an hour to listen to, but if you have the time and are at all concerned about this issue then you need to hear this.

It is hard to keep up with whether this is technically a war or not.
The targeted regimes were deposed. Saddam Hussein is gone. The Taliban isn't an actual coherent political body in Afghanistan: It's anyone who wants to start a gang and call themselves Taliban.
In all most previous American Wars(French-Indian,Revolution, 1812, Mexican-American, Civil, Spanish-American, WWI, WWII) prisoners were released shortly afterwards.
Since we're in Afghanistan and Iraq now more or less as police or janitors, the prisoners should be released to those countries to be tried on whatever laws in those countries they may or may not have broken. It is ok: even if they go free they'll probably die of deprivation or sectarian violence within a few years. It is cheaper than keeping them in American prisons and flying American specialists out there to interview them.
The gangbangers of Los Angeles, Detroit, or Cleveland are no match for the police in direct combat. Police are much better trained and equipped than ever before. Things will settle down when the squad car rolls up, and things will pick up a few minutes after the squad car rolls by. Sustained victories in the War on Crime have been elusive. Soldiers in Afghanistan and Iraq have much more latitude to shoot at offenders, but the parallel will only deepen.
Within a few years or decades our involvement in Iraq and Afghanistan won't matter. The Middle East will become so overpopulated relative to its water and topsoil and capacity to provide productive or busywork jobs for its residents the place will devolve into constant violence.
