The Huron Report commissioned by City Council indicated that, while the LHA RFP process was not perfect, such imperfections would not have prevented any entity looking for such opportunities from learning about this opportunity and expressing interest in responding to the RFP.

Thank you again for engaging.

Huron Consulting LLC was part of and embraced a rigged and steered bid process--I am sure you remember that there was one RFP for CCF and another RFP for a small hand full of others who were not allowed to bid on an FHC/ER. Huron thought that was okay--Do you think that is okay? That is a bit more than an "imperfection"--it was a fraud and Mr. Butler continues to concealing his, Thompson Hine's and CCF's interactions and representations to Huron Consulting.


Please note Mr. Butler's response to my records request in which he admitted that Huron worked for CCF from the beginning of its engagement and he rufused to provide:

BUTLER on July 15, 2016: "At the time Huron was engaged, the issues included in their engagement were directly implicated in the lawsuit filed by Mr. Graham and others, and they remain so.  As such, because these trial preparation records and joint defense communications to or from me and Mr. Colarusso and/or Mr. Bodine are exempted from the Public Records Act or are not records, they will not be provided........Your request is also denied to the extent it seeks communications to or from me and Mr. Colarusso and/or Mr. Bodine, because those communications have been prepared in preparation for trial in Graham v. City of Lakewood, et al. and are therefore not public records pursuant to R.C. 149.43(a)(1)(g).  Additionally, your request for my communications seeks records prepared by the defendants in the same lawsuit.  The defendants, including the city, which is represented by me, have exchanged joint defense information in confidence with the intent and for the purpose of facilitating the rendition of legal services concerning common defense interests, with the expectation that the information will remain privileged and confidential and will not be disclosed without the prior written consent of all of the defense parties.  Those parties include Toby Cosgrove, CCF and CCF Trustee Tom Gable.

So Mr. Butler is working with Toby Cosgrove and Tom Gable who you told me somehow refused to allow the city to issue an RFP for our hospital.

I guess that fact was concealed from you concerning Huron's engagement--Huron was always working for CCF, Cosgrove and not City Council and according to Mr. Butler, Huron continues to work for CCF, et al.

Please read what Mr. Butler wrote (above) in his official capacity for the city.

Namely, that Toby Cosgrove and the Clinic control all the information Huron relied upon and all communications between Mr. Butler and Huron--Huron works for the Clinic and has done so from the beginning. So essentially in a very real sense Mr. Butler is working with and for Cosgrove and the Clinic with respect to Huron and oter matters. It is all documented and can't be plausibly denied.

I am sure some information Huron obtained from the Clinic involved non disclosure statements. (I have non disclosure statements in my line of work as well where I cannot release records without the express written consent of the entity from which the info is obtained.)

So, if you were the Clinic's lawyer you would advise to release any and all documents in the face of a multi hundred million dollar lawsuit? It is safe to say that the Clinic's lawyers, Jones Day, advised otherwise.

All this coming from the new Mayor's mouth piece. Mr. Anderson, can you tell us why Ms. Marx received a thousand dollar donation from a Huron Consulting employee and also Cleveland Clinic? Can you tell us why we, the tax payers, are paying to tear down the south medical building for Cleveland Clinic? Can you tell us why it is so important to tear this building down prior to the election? Isn't this a waste of money should the against side win? Can you tell us why Council, Summers and Extended Company are allegedly stealing homes from the less fortunate resident's of Lakewood, such as the terminally ill, seniors, Blacks, Hispanics, etc.? Is there alleged racism going on now in Lakewood?

Why are these homes being torn down that are either in good shape or of historical value? Why does it appear that some residents continue to receive bills from the city after the city has allegedly seized their homes, without due process, and torn them down? Why does the Cuyahoga County Land bank claim that no HUD homes and land are given away for free, but then it appears that the City has done this for their friends?

Why are the residents at the Westerly alleging that Curt Brosky is threatening them and telling them to keep their mouths shut and to not talk about the hospital?

Why will our Fire Chief continue to hide behind the "Hippa" Law, and not show us the run sheets for EMS, showing us how long it TRUTHFULLY is taking to get a person the proper care?
Why are Summers and Council appearing to hide the TRUE crime that is happening in Lakewood? The eastern end of Lakewood is ridden with crime, but, it appears that since you all are so busy trying to cover your asses, you ignore the city and what is going on in it.

I am sick and tired of all you self serving alleged thieves spewing Bs without showing any documentation to back up what you are saying. I have brought plenty of evidence here on the Deck in regards to the alleged housing scams going on in Lakewood. How about you bring genuine documentation to explain all the above questions, including the PUBLIC records Mr. Butler is REFUSING to release, which by law, we have the RIGHT to see!

I have also noticed that Lakewood Police department do not appear to be listing Heroin overdoses, Heroin deaths or Rapes on the crime maps anymore. Why? I recently asked our Mayor to post on the Deck about the Rape that happened not to long ago? Silence. Why? Crime happens everywhere. We do not expect perfection, but we do expect the truth! Mr. Anderson, I believe it is time for you and the rest of Council along with Summers and Butler to resign.

P.S. I believe that Council received multiple offers on the hospital. It appears you all ignored them because you all had your eyes set on the prize!

Your words expose a most fundamental misconception and erroneous premise upon which seemingly logical thinking rests---that false premise has undermined the entire the process and has dictated the bad result.

The records pertaining the Lakewood Hospital are OUR records, not the Clinic's records. The Clinic was a paid servant and owed US fiduciary duties to take care of US and OUR hospital--there could be nothing confidential as between US and the Clinic (save only patient information).

The lawsuit was and is about a failure on the part of our fiduciaries (the Clinic LHA and Summers) to be transparent--it was started to create transparency--to suggest that the lawsuit justifies deeper secrecy on the part of the City and the Clinic and high priced mouthpieces turns logic on its head--it is also 180 degrees from the contractual and sworn duties of all the defendants obligations.

You concede that the Huron process was not transparent and controlled by the Clinic withholding OUR information---the fact that the City cowered to the Clinic and capitulated in its fiduciary duties to the citizens exacerbated the wrongs of powerful corporate greed and arrogance run afoul.

You have expressed some logical thinking, but it rests entirely upon false premises.

The City Council and City Administration are damned by the bad process and damned by the bad result.

The only question is whether the people will see through these charades on November 8th.
