I originally wanted to take photos of the art, but after being harassed by an artist for doing so (although the art was in a public place, making it fair game), I scrapped it.

While I agree I should have asked before snapping the photo, he should have known that he was in a public area. Having photos taken of you and/or your publicly displayed artwork is pretty much inevitable, and a release is not required.

you will come across many people that don't want their photo taken. I was right by you as we both were verbally attacked by the artists husband.
"Where is your ID badge?" the man screamed at us.
it's morons like that that don't deserve your time of day or the LO's time of day. I have always stayed away from giving any kind of press to anyone that isn't worth it.
sometimes that's the only thing you can do. It's something I never had a problem with, because after all, we're doing them a service.

That would probably be a good thing to have.
I know I have been in several places where in a group photo of kids, a few parents don't want their childs pictures taken...I can't blame them...that's way I ask first before I take pictures of kids. The last few times I have taken this group of kids..the parents now ask..now this is for the Observer..right??...I say yes...and let them know it may be on the web site too!..they have been very receptive and have said yes...for the Observer.
Most of the time I let them know..so they know we are giving them free publicity...Ivor is right...If they don't want it taken..I'll be nice..forget it.

Both of you have LO business cards. I know that for a fact. While many people would get upset with someone taking a photo of them, I do not think they would get upset if you take the photo, THEN ask them their names and write them down. While you give them a businees card. You know a thing called captions.
I took photos all night at Starry Night, and got no complaints, most asked when the picture would appear.
At the arts festival, the artist I shot were happy to get into the paper.
While I agree that the arts festival would fall under news, and as long as no one was selling photos to make a profit, would be allowed to shoot away. So ask, write down the name, and take the picture.

I wrote down the name..... all I wanted to do was ask the artist if it was film or digital.
Regardless, I can sit here and post the persons name, and bash it all day long. Even bad press is good press sometimes.
They just had a print that was stolen, so I think we came with questions at the wrong time.
But it's not like david walked right up to a frame and clicked away. He wanted to take a photo of the whole stand, with people looking at this artists work.
These people naturally weren't from Lakewood, so they don't know how things work up here.
