the two parties have inched and pivoted their ways into different platforms over the years. as the nation changes, and the marketing and leadership changes, and party leaders lead those changes.

generally, most white democrats of the southern persuasian have become Republicans. it generally had nothing to do with free markets or tax levels or big government or small government or even much of religion. but those issues are the planks in th platform, and at least add some semblance of legitimacy to it(if only really in terms of sentiment).

So, this is just another frivolous lawsuit.
