Rep. Dennis Kucinich sues cafeteria over olive pit in sandwich

WASHINGTON, D.C. - Rep. Dennis Kucinich has rapped a U.S. House of Representatives cafeteria with a $150,000 lawsuit for selling him a vegetarian sandwich wrap in 2008 that he says caused dental damage when he bit into an olive pit.

The lawsuit that the Cleveland Democrat filed Jan. 3 against operators and suppliers of the Longworth House Office Building cafeteria says the sandwich he bought there "on or about" April 17, 2008 "contained dangerous substances, namely an olive pit, that a consumer would not reasonably expect to find in the final product served."

Biting into it caused serious "permanent dental and oral injuries requiring multiple surgical and dental procedures," the legal documents say. They contend the congressman is entitled to damages for future dental and medical expenses and to compensate him for pain, suffering, and loss of enjoyment.

"Said sandwich wrap was unwholesome and unfit for human consumption in that it was presented to contain pitted olives, yet unknown to plaintiff, contained an unpitted olive or olives which plaintiff did not reasonably expect to be in the food prepared for him, and could not visually detect prior to consumption," the lawsuit said.

A scheduling conference on the case has been set for April 8 before District of Columbia Superior Court Judge Gregory E. Jackson.

Kucinich's mishap occurred several months after the vegan congressman abandoned his second ill-fated presidential run. On the day of the incident, Kucinich chaired a hearing that examined whether cattle were being abused in California slaughterhouses.

The dental damage didn't keep Kucinich from speaking out for long. On April 24, he appeared on Fox News Channel to discuss rising fuel prices with Neil Cavuto, transcripts show.

Kucinich's congressional office referred questions on the case to his attorney, Andrew R. Young, who declined to comment further on the suit or on the extent of Kucinich's injuries.

"It truly is a private matter," said Young, a former aide to Kucinich who has also served as a North Ridgeville council member.

A spokeswoman for the North Carolina-based restaurant company that operates the cafeteria, Compass Group, confirmed it has received the lawsuit and is reviewing the matter.

"Beyond that we don't comment on pending litigation," Compass Group Vice President Cheryl Queen said in an e-mail.

Kucinich's lawsuit also names a pair of food suppliers to the cafeteria as defendants.

Julie Botset of Performance Food Group said her company "will not comment on litigation or offer any comments on this case."

Spokesmen for the other food supplier, Foodbuy LLC, did not respond to a request Wednesday for comment.

State Senator Jim Alesi fell off a ladder and broke his leg at someone else's unfinished home three years ago - and now he's blaming the homeowners for his injury. Alesi is also suing the home builder, Louis DiRisio.

This comes as a shock to DiRisio, who says the front door of this Perinton home was locked when Jim Alesi tried to go inside in January of 2008. DiRisio says Alesi went down around to the back and found an unlocked door to the basement.

"He had absolutely no right whatsoever to be in that home," DiRisio says. "He didn't have permission. He was a trespasser."

In fact, the homeowners had the option to press criminal trespassing charges against Alesi, who suffered serious injuries that required surgery when he fell from the ladder. But the homeowners tell us they didn't want to make a bad situation worse for the Senator.

The under-construction home was already sold by the time Alesi decided to check it out, but Alesi apparently thought it was still for sale.

Page two of Alesi's filing says "the premises were not reasonably safe." When he decided to try to climb a ladder -- because there was no functional staircase in the unfinished home -- the filing indicates that Alesi was placed at risk because of "the negligence of the defendants." Thus, Alesi concludes that his injuries were not his own fault.

"Look, it's a job site," DiRisio said. "A home under construction. There was a ladder going from the basement to the first level of the home, and he slipped going up the ladder. The ladder didn't break. There wasn't a malfunction there. In fact, I still have the ladder if you want a photo of it." Then DiRisio added, "I suppose it might not have been safe for someone who is not familiar with operating a ladder, or for someone without proper footgear."

DiRisio showed us the ladder, which does appear to still be in solid working shape.

So why would Alesi sue now, three years later? The homeowners told us he never complained after the injury, nor did he thank them for declining to press charges.

The statute of limitations for trespassing runs out after three years. That means that as of this past Tuesday, the homeowners could no longer sue Alesi for trespassing on their property. As it turns out, that's the exact same day he filed his suit against them.

Friday afternoon, Senator Alesi called us back and would only read a statement over the phone. He said, "My attorney has filed a civil lawsuit on my behalf... beyond that I have no comment." When I tried to ask questions, the Senator hung up the phone.

The couple who lives in the home is shocked. Lou DiRisio says there will be no settlement with Alesi. "The support that I've received from friends, family, people I don't even know... it's been amazing."

Republican leadership outcry helped convince him to stop the foolish suit. Do you think the dems will step up against Dennis?

I am sure some flaming heart liberal on this site will somehow twist this into Dennis standing up for the little guy. :)

Actually I think we would file this under the Congressman standing up for himself.

I do find it odd when an American stands up for himself, he is belittled, when he stands up
for others he is belittled. Doesn't really leave a lot of wiggle room.

There are a few different stories regarding Bachmann. I 1) don't know which story Bryan is referring to and 2) don't see the relevance. Is she suing someone?

Are you talking about the Tea Party SOTU response? Is it the Chris Matthews thing?

I wasn't trying to be insulting, just telling the truth.

IMHO, people with an extreme political ideology aren't really interested in learning anything different than what might support their preconceived notions. So why try to educate a person who, in all honesty, really has no interest in truly learning something that would conflict with what they already think is the "the truth"?

It's about as futile as trying to get Osama Bin Laden to convert to Buddhism or getting Sarah Palin to keep her mouth shut. (Ask John Boehner about that last one) ;)

May I infer, then, that you consider my political ideals to be extreme? I would consider myself no more extreme than our founders (by nature of the fact that I would like to see the country return to its Constitutional roots).
Are they then, in your opinion, extreme as well?

Message boards are about dialog and that is what I'd like to have. Maybe I'm not as extreme as you think. I am interested in understanding why you (collectively, not just Bryan) think, feel and believe what you do.

Our nations founders disagreed with each other on many things.
one of the things they had in common was that many of them had no teeth.
and they had no cafeterias to order refrigerated sandwiches from.
I don't know how many of them died from food poisoning.
