In mid-September, I noticed that a convicted sex offender was released from prison and had established a residence on Carabel. This is less than 1,000 feet from Hayes Elementary School. This individual establishing a residence this close to a school is in violation of state law. On August 17th, this individual was convicted of pandering sexually oriented material involving a minor (for details of what this statue entails, see R.C. 2907.322).
It is not a criminal offense to establish a residence this close to a school. Rather, it is a civil matter between cities and offenders. The city must file an action for injunctive relief in court in order to make the offender move. I was told by the city that they have never had to file in court to make a violating offender move. Rather, they typically send a letter telling the offender that they only have so many days to move.
No, this offender cannot be grandfathered in. He was just released from prison about six weeks ago.
