Help me you legal eagles.
If I read this right, after appealing the decision, the Lakewood Board of Education is required to have 2 people in these two positions.

Seems as if there was a summary judgement in the appeal for the union against the Board of Education.
1) Did Mr. Berdine get extra pay for holding the two positions?
2) Does 2 people having these positions involve some checks and balances on our spending?
3) How much did the legal wrangling cost the school?
4) How much will having 2 positions cost the school?

according to the affidavit from Berdine, he was asked by the BOE to perform both duties and was never awarded employment for another position. No contract was established.
Adding the two positions would arguably cost the district anywhere from $60,000-$100,000 depending on salaries.
I doubt that a Business Manager would make more than $40,000/yr working there but I could be wrong.
We'll probably have to wait and see!

Are schools not covered by home rule? It seems as though if they were, they would be free to determine their own job descriptions. The difference between treasurer and business manager seems like the difference between police chief and safety director.
I do know that schools are subject to exhaustive audits by the state and Lakewood always gets top marks. Also spending must be approved by the board, which appears to be the ultimate check and balance.
I think the union should also be challenged to address this. Why was this necessary and what will be the benefit to the taxpayers and students of Lakewood?
