Does anyone else have this problem with their children passing up to the next grade when they have been failing all year?

My daughter does get tutoring. However last year due to serious illness she missed more then 60 days of school last year. There was so much work that she did not even get the chance to make up. However she passed....We asked and requested that she repeat that grade. The schools would not even consider it.

My daughter has passed every year even when she had mostly F's all year and than in the last qtr wow she made passing grades. We have even called the school board and requested that she be held back. She is in 9th grade this year and has even asked several time if can hold her back next because she is falling behind.
