Court Rules That Discovery to Proceed--Summers Must Testify Under Oath

The Judge in the taxpayer lawsuit denied Mayor Summers' and CCF's motion to stop discovery.
This means, among other things, that Mayor Summers will have to testify under oath in a deposition before a court reporter.
Chalk one up for the good guys!

I can't wait to hear what he has to say!
I was wondering, will the mayor be alone during deposition or will he be with his council (K.Butler) to hold his hand?

He'll have all of his lawyers.
If there is ever a Grand Jury, he will be alone.

I am grateful that the judge did not stop the discovery process, however, he is allowing another six weeks for Summers, Council, and CCF to continue to decant the hospital. It seems to me the judge should of and could have done more.

I'm no lawyer, but doesn't he have to be asked to do more, for example, an injunction? SLH has good lawyers, so I trust they know what they are doing.

I asked, but received no response. If they have not filed for an Emergency Injunction, I would certainly like to know why not. A lot of damage can occur in six weeks.

They told me they tried it before and it didn't work. Seems to me the situation has just changed with the Clinic's big meeting at the hospital, but it's their lawsuit.

im just speculating, but since the deal is not officially signed, and there is no official date of the closure, even though it was mentioned possibly first quarter, im sure once things are official, after council votes december 21st, im sure things will likely change.....
I would assume if the closure date is before the ruling of the judge , that is when the emergency injuction would occur................i could be totally off base or wrong, but im just trying to think logical. Im sure in the next few weeks these things will be touched upon. why was that surgical developers not allowed time to make an offer? just odd it being a public asset. Im really surprised that somone has not bought the whole hospital. We shall see.

You may see a federal review before any deal is announced.....
Typically when a complaint is submitted to the Federal Trade Commission it gets a joint review from the Department of Justice. Both agencies have jurisdiction over anti-trust complaints.

Interesting tidbit: Ohio doesn't have a U.S. Senator on the Judiciary Committee which has direct oversight of the FTC/DOJ.

Why weren't Surgical Developers afforded an audience with the mayor/council etc.(?), is that this "deal" has been in the works for over 5 yrs. No one is about to change direction now. In fact, they are fighting tooth and nail to stay on course.
Nothing for Lakewood, everything to the Clinic (our health care heroes!).
Simple as that.
