January 28, 2015: At the Beck Center recorded forum, Mayor Summers said: "Throughout the process the primary goal has been to provide for the evolving healthcare needs of the citizens of Lakewood and our surrounding communities while advancing the economic revitalization occurring in our business district." (you-tube at 9 minutes).

The mission of the Lakewood Hospital Association is to run a hospital---it is a public charity organized for that purpose---it is in possession of public assets pursuant to a Lease to run a hospital for the City of Lakewood and its residents.

Mike Summers and the other LHA trustees have violated their fiduciary duties of loyalty, duty of care by having the goal of "advancing the economic revitalization occurring in our downtown business district."

So Summers' ongoing efforts, including, but not limited to, his latest workshop designed to foment community excitement in the downtown using charitable property of a public charity he owes fiduciary duties to be loyal to and care for is further evidence of his ongoing violation of Ohio Law.

That is true for the other trustees, Madigan and Bullock to the extent they are supporting using charitable assets i.e. hospital land for economic revitalization.

What makes matters worse for Summers is that he is likely violating his oath of office as Mayor by refusing as our Mayor to enforce the City's rights under a Lease that was created by a City Ordinance that is still the Law of Lakewood, i.e. his duty is to faithfully execute the Laws of the City of Lakewood.
