The Committee of the Whole will meet Monday, April 22, 2013 at 7:30 PM in the Jury Room of Lakewood City Hall, 12650 Detroit Avenue. The agenda is as follows:
ORDINANCE NO. 8-13 - AN ORDINANCE to amend Section 1105.02 of the Zoning Code of the Codified Ordinances of the City of Lakewood by changing and revising the Zoning Map of the City with respect to certain property as set forth and described as 18828 Sloane Avenue (PP#’s 311-14-018, 311-14-019 and 311-14-102) also known as the Clifton Pointe Phase 2. (PLACED ON 1ST READING & REFERRED TO THE PLANNING COMMISSION 3/18/13, 2ND READING 4/1/13, REFERRED TO COMMITTEE OF THE WHOLE 4/15/13) (Pg. 45)
RESOLUTION NO. 8649-13 – A RESOLUTION to take effect immediately provided it received the affirmative vote of at least five (5) members of Council otherwise, it shall take effect and be in force after the earliest period allowed by law, to appoint_______________________as a member of the City of Lakewood Board of Nuisance Abatement Appeals for the unexpired term, ending December 31, 2015. I have a question about the timing of this meetings posting and the actual date of the meeting.
Are there any rules or sunshine laws that state how much time should be given to the public on these public notices.
This meeting was posted to the public on Friday. The meeting is being held on Monday. Is there anything anywhere that states that the public should be given more notice than one business day to prepare to attend a public meeting?
Just to clarify, what are the rules?

Rhonda - not sure if its Ohio Law or Lakewood Ordinance but I'm quite sure the public notice requirement is as little as 24 or 48 hours.

Matt would be the expert on "Sunshine Laws" and is a real advocate as we all should be that public groups follow them.
I do remember recently that council passed a one reading rule was OK as a way to stop wasting time with frivolous/non-important readings like Resolutions for people. I was worried at the time that other items would eventually find themselves getting the "emergency push" but notice this has at least two readings planned.
I believe that Law Director, Kevin Butler would have the best answer, and will call shortly.

yep...24 hours...state regulations I guess....I still don't think it is enough time for residents to respond. But it is what it is and we have to monitor it. And we move on...

Never settle!!!
The beauty of our legislative process is that citizens CAN (and SHOULD) be involved. And that process includes numerous ways to get ordinances (or our Charter) changed. Some ways are more arduous than others, but if enough people feel that "change" is in order, that then burden is shared; the work become less formidable. Power to the people!

It is a great idea to try to get it changed, but right now it is what it is and we have to deal the hand we are dealt and work within the system.
