I'm not surprised by the decision, but I'm wondering why it took so long to issue it. If the election was the deciding factor, that was eight months ago.

We lost that election by ONLY about 400 votes - which was the net of Clifton Park votes against us. The rest of the city was more or less, 50-50, and netted about even.

It is sickening that the judge could sit on his hands and let his delay work in their favor.

I am proud of all who stood together to fight this travesty of justice. You all know you did the RIGHT thing.

Not only did we lose the election by a very small margin, when does public opinion become the basis for a legal ruling. If public opinion ruled, segregation would still be in full force. It takes the strong arm of the law sometimes to effect change. In this case, lies and deceit of the public is a wrong. How can a judge decide that presenting the TRUTH is not important.

Why does he take months after the Referendum lost by a miniscule percentage to deny due process?

Why is having a trial a MOOT POINT? This is like saying stop the murder trial because the victim is already dead.. Don't we still need to know the TRUTH.

I am not an attorney and those that are can LYAO at my ignorance.

Somebody please tell me why the law does not back up highlighting the deviant behavior of the Fitzgerald through Summers Administrations. Jim says the wrong entities were sued. THEN, we should have known that there was no standing (or something) 2 years ago. THEN a new lawsuit could have been executed. Judge O'Donnell actually stood in the way of justice being served by his delay tactics.

Bad Karma Your Honor.../

Might makes right.

Sad day. I know a lot of you worked really hard on this and it feels like you've now been swindled twice, by LHA and now each of the branches of city government. As CYA a move as I've seen.

Has anyone reported Judge O'Donnell to the proper authorities yet? There is no doubt in my mind now that O'Donnell is an alleged crook and has had a BIG part in all this.

I believe when all is said and done, he may loose his license, as he should!

Lori

In his opinion he states clearly not just why, but roads to appeals or other lawsuits, should anyone care about picking them up.

While people love to speak of corruption at the county level, I prefer to think the judge worked within a framework many could pick up.

An example is his ruling there was not enough evidence presented, while we all know City Hall lied to the courts and stonewalled them.

The documents Essi's group has found recently, along with other things happening at City Hall, will certainly blow this open again soon.

I cannot answer if we needed the hospital or not, but I know we need an honest and transparent city hall. Something Lakewood is missing right now.

See attached a copy of the dismissal. I will have to take a few days to a week and look up all the cases Judge O'Donnell cites to really understand this. I am sure some of you already have. Enlighten us if you have any clarification.

Thanks.

I'd appreciate hearing from some of our legal experts on the judgement. After reading it through, his reasoning seemed sound to me, but what do I know?

Jim,

I appreciate your input, however, I believe when all is said and done, all will see that the County is involved in these alleged crimes.

Tick tock. Tick tock. Time will tell!
