While I think the injuries are minor and subsequent suing is a bit much, I don't think people should be able to DIY a sidewalk like this and think it is ok. I can't tell much from the pic, but if a sidewalk is heaved, you cant just build a small 'ramp' transition from one piece to the next and call it ok. This patch looks awfully abrupt. There are codes about the pitch of handicap ramps, thresholds, transitions, etc because steep and abrupt transitions like this can be just as bad of a trip hazard as the space between two pieces of heaved sidewalk.

Just my two cents.

Valerie--- sometimes the City itself doesn't make repairs after an accident. I was listening to the scanner about two summers ago when I heard the dispatcher call for an Officer to respond to the ER to take a report from someone who had tripped and suffered an injury on a sidewalk in front of the main fire station.
The next day I saw that the crack had been painted orange, thereby warning of and acknowledging the problem.
That crack wasn't repaired until just this past Fall when the new 9/11 memorial was built and numerous spectators were expected.
So, I guess the City has to keep its act together, also.

If you choose to run, then you accept the risks of injury that may follow, especially in Lakewood with all of the uneven sidewalks. My guess is this girl is from out of town. I say this as a runner. Over a year ago, I was running in Lakewood and was bitten by a dog--that probably was offense worth suing over, but I didn't. It appears that this "victim" has some delayed life lessons to learn, like responsibility for one's actions. Get over it!

Jerry

Nice, is that your work?.

Not really, it's a meme blank from knowyourmeme.com. Most of them you can add your own captions. The lawsuit sounded so ridiculous it put me in mind of the overblown acting on CSI: Miami :)
