Mr. Grossetti, This suggestion that currently living outside Lakewood makes one's opinion irrelevant, coupled with the farce of objecting to using an initialed first name (which by the way is not a pseudonym), is Lakewood's version of the Birther movement. It's designed to deflect discussion. It's designed to distract the community. To once again drag us down "the rabbit hole", far away from the reality on the ground.
It's a cheap attempt to discredit and de-value what's being said without having to address the issues.
Mostly it's predictable and boorish.

Out of sheer curiosity, can you please cite the law that states it is illegal to throw away items that are offered to the public for free - such as a free publication left in scattered public places that are meant to be taken for free.

I wonder how the law works when the words "Free - Take One" are listed on the cover?

It is called the first amendment. The owner of Get-Go can throw away anything he wants, it is his store. If you do it, it is Federal Court, and with a photo you lose. Removing a political sign is a $200 - $1,000 fine for each case, first amendment, Papers are worse and allow us to recover damages.

City Hall can regulate papers in their lobby, just not after 307 issues, for content. First Amendment violation.

Psssssst, I did, it is called the First Amendment. You know that crazy little thingy before the 2nd Amendment.

There are lawyers, not organizations that protect that law, actually many for free, as groups like the ACLU only have one law and client they work with, the First Amendment. The 2nd amendment came after the first to help protect the first.

Which Clause or Act in the Bill are you referring to? I know of ones that protect citizens from being governed on speech but not ones dealing with throwing away free, publically placed newspapers. Maybe you are thinking of destruction of property or perhaps vandalism for throwing away another person's trash. Seems like the disposal of other people's trash is a much talked about subject here - maybe the removal of the trash is a good thing.

Corey read the answer in one of the many other posts you have on this subject.

The law is called the First Amendment.

Doesn't even have to be a paper, could be a garage sale flyer, or political ad.

Simply put...
First Amendment allows the person to produce it. First Amendment allows the owner of the business to throw it out or not allow it. First Amendment would protect the producer if a third party threw it out or took them. In a simple theft case you would be right, but you could be charge the cost of producing them. In a First Amendment case, damages could be assessed and federal penalties.

Public entities like City Hall, the Library and Parks have a different set of rules. Hence, no locked door meetings at the Library. Closed doors only at "Executive Session" at City Hall. Where they can legally ban and control things, unless a precedent has been set.

The First Amendment allows the LO to Produce a Paper and run this site. It also allows us run this forum. This is where it gets tricky. You have a first amendment right to post whatever here, within it's limitations which are very broad and any rule here also enforced very broadly. But it doesn't give you a right to post here.

Just like the deli owner that can throw the paper away, or report them being stolen.

That doesn't begin to explain why you want to set up stakeouts and lynch mobs to take pictures of people throwing papers in dumpsters as you put it. No rule against someone grabbing a free paper (or more than one paper) and throwing it away. In fact, they are doing their civic duty of disregarding trash. But you want to give a $ reward for pictures of someone throwing away trash? Okay. Maybe you will get lucky and the photo will be taken in a park - after hours.

never mentioned stake outs.

throwing an Observer away in a park, if found there would be proper. We have no drop off points in the park. It would have been taken their and left like litter, and like all litter, should be cleaned up.

That is far different than say, Roman Fountain, where the owner keeps them on the counter by choice. He understands the paper, and how it works and has supported the efforts of all of us. Picking up papers there, going outside and throwing them away, COULD be considered an attack on the First Amendment rights of the LO and Roman Fountain.

You can legally stand in a movie theater and yell, "VOTE FOR HILLARY" and be protected by the First Amendment, all the way up until the owner of the theater asks you to leave for doing it, than his rights come into play. As they escort you on to the street, where it becomes a completely different game again.

No, that is not was meant.

I meant, it would depend on the court, and those investigation.

Just because a police, or investigation goes to a prosecutor, doesn't mean it goes to prosecution.

COULD, me it is up to the courts to offer the opinion on.
